DIRECT TAX CODE

This is a news item appeared as answer in The Tribune to a query/question raised by a reader.
Question: We have come to know that under Direct Tax Code for sec.80C one can invest as under:
1. PPF-Rs. 1 lakh maximum
2. LIC-Rs. 50,000 maximum
Does it mean that u/s 80C under the Direct Tax Code, total investment eligible for tax rebate would be Rs. 1.50 lakh as against Rs. 1 lakh currently?
A. Under the new Direct Tax Code(DTC), while the upper limit for total tax saving investments is indeed enhanced to Rs. 1.50 lakh as compared to Rs. 1 lakh currently, nonetheless there are certain condition. The Rs. 1.50 lakh deduction is split into two parts-Rs. 50,000 and Rs. 1 lakh, respectively. The Rs. 50,000 deduction is specifically available only in respect of life insurance premium paid (where the sum assured is at least 20 times the premium), health insurance mediclaim and tuition fees of children. On the other hand, the Rs. 1 lakh limit is available in respect of provident fund, superannuation fund,gratuity fund and contributions to NPS.
In the case of PPF, at least it seems from the initial reading, that the limit will stay put at Rs. 70,000. It is pertinent to note here that the Rs. 70,000 limit is as imposed by PPF rules. Therefore, unless the rules in the PPF Act are changed, the limit will continue top apply.

REVISED CHARTER OF DEMANDS

Following is the charter of demand likely to be submitted to Directorate. Now it depends on the CHQ how it is pursued for implementation. If any member has objection to any of the demands, the same can be commented so that it can be pass to CHQ for rectification:  
On the basis of feedback received from CHQ Office Bearers / Circle Secretaries, CHQ has made some modifications in the charter of demands. Revised Charter of Demands is reproduced below for information of all members. This will be submitted to the Department shortly.
i. Up-gradation of Grade Pay of Inspector, Posts from Rs. 4200/- to Rs. 4600/- with effect from 01.01.2006 and merger of post of Assistant Superintendent, Posts with the post of PS Group 'B' as both are having Gazetted status and difference in Grade Pay is only Rs. 200/-.
ii. Implementation of the recommendations of Second CRC and restructuring of Inspector, Posts cadre as an Inspector is getting promotion in P.S. Group “B” only after 24 to 26 years of service in Inspector, Posts cadre. 
iii. There are 866 posts in PS Group “B” cadre. At present 75% posts i.e., 649 are filled through DPC on the basis of seniority cum fitness. 19% posts i.e., 165 are filled through LDCE among IP line officials and 6% i.e., 52 are filled through LDCE among General Line officials. Consequent upon the introduction of Postmaster cadre, there should be no change in 75% posts i.e., 649 posts through seniority quota. 87 posts of Senior Postmaster to be filled up through LDCE of IP line officials should be adjusted in 165 posts of existing examination quota of PS Group “B”.iv. Consequent upon the introduction of Postmaster cadre, suitable amendment may be made in Recruitment Rules of PS Group “B” cadre revising quota of IP Line through seniority from 75% to 87%, IP Line through LDCE from 19% to 10% and General Line from 6% to 3%.v. Supply of Laptops to all IPs/ASPs.
vi. 141 HSG I IP line posts may be re-designated as Assistant Superintendent Posts as it is a promotional for Inspector, Posts.
vii. Revision of rates of remuneration for performing duty as Invigilators in the examinations.
viii. Promotion earned through examination should not be counted while granting MACP.
 ix. Holding of periodical meetings with the Association at regular intervals. 
No periodical meeting has been held since long time despite submission of agenda for the same.

UNFORTUNATE DECISION

Don't be afraid of  proposed strike, now there is no strike from IP/ASP side. I am still of the view that we should go for mass casual leave at least on the first day of strike, if  we do not have stamina to go for even one day strike . Any way we have to abide by the CHQ. Following is the decision from CHQ:

In response to the Email/SMS sent to all CHQ Office Bearers and Circle Secretaries on 10.06.2011, Two Circle Branches have not replied so far. One Circle Branch is defunct. 19 Circle Branches have replied as follows:

Majority of the Circle Branches are not in favour of the strike. Hence, CHQ is not issuing strike notice with effect from 05.07.2011. In the meantime, CHQ will try its best to get our demands fulfilled through negotiations with the Department.

VIEWS ON STRIKE

Dear Roop Chandji
The Punjab Circle Association welcomes the initiative of the CHQ to build up a united struggle for the cause of IPASP. The members of the association have conveyed their support to all the demands given in charter in one voice and appreciated the united strike call.  In view of the response of the members we are of the view that we should join Strike on 6th July 2011 keeping 5th July reserve for mass casual leave. The threat or actuality of a strike by an association is a powerful tool so we should grab it by availing mass C/L on 5th July 2011, strike on 6-7-2011. For rest of the period we should extend full and whole hearted support to the proposed indefinite strike.
It is also requested that para (iii) of the charter of demand may kindly be amended as under:
“Consequent upon introduction of postmaster cadre there should not be any representation of General line officials in PS Group B now. Out of 116 post of Sr. Postmaster, 52 posts of Sr. Postmaster should be filled up from General line and rest of 64 posts may be filled from IP line through LDCE”. For this, though both the recruitment rules have to amend suitably.

VIEWS ON EXTENTION OF SUPPORT TO STRIKE


As you are aware that CHQ has already extended its support to the indefinite strike call from 5th July 2011 given by Postal JCA comprising NFPE, FNPO and GDS Unions. General Secretary  through email and SMS has asked CSs to consult our CWC members and take a decision whether we should also go for strike and issue notice to the Department for strike with effect from 05.07.2011 for non settlement of our cadre issues .The final decision of our Circle is to be conveyed to GS by 13.6.2011. Keeping in view the decision of CHQ I request all the members to convey their opinion to Sh. INTERPRETATION OF POST CALCULATIONS

Following is my interpretation to your queries, you are asking off & on and it is possible that at every point of clarification I may be wrong but before making your mind ruling point may kindly be consulted.
Point
Explanation
Consequent upon introduction of Postmaster cadre 116 posts are to be carved out from General line then how these can be reduced from 814 posts        ( 94% i.e 75% + 19%) meant for IP line
In para 5 of the postmaster recruitment rules 2010, it has been mentioned that 75% i.e 87 posts will be filled through LDCE from IP line and 25% i.e 29 posts will be filled from general line officials through seniority-cum-fitness. Since these posts have been distributed between IP line (LDCE) and General line officials so these posts can be reduced from total Group ‘B’ strength of 866. 
When 116 posts of Sr. Postmaster have been taken out  from the strength of 866 reducing the posts for PS Group ‘B’ to 750 then why percentage is not being worked out as under in each quota:
75% of 750 = 563 ( Seniority cum fitness)
19% of 750 = 143 ( LDCE)
Since these posts have been carved out from general line hence now there should be no share for general line now.
Since department has not amended PS Group ‘B’ recruitment rules 1987 hence percentage effect can not be given on reduced post. Presently PS Group ‘B’ recruitment rules 1987 amended from time to time are in force. As per these rules 649 posts in PS Group ‘B’ are to be filled through seniority cum fitness and 165 posts are to be filled through LDCE. Moreover 100% distribution of 750 is to be chalked out and 94% of 750 can not equalize the number of posts in two quotas. Now as per Sr. Postmaster recruitment rules 2010, all the 87 Sr. Postmaster posts allotted to IP line and presently held by PS Group ‘B’ officers are to be filled through LDCE examination only and 29 from General line officials through Seniority cum fitness. Roster of 19% (LDCE) and 6% has been maintained separately hence till recruitment rules 1987 are amended the effect could only be given in 19% and 6% roster.  
How much effect can be there on 649 posts (75%) if recruitment rules are again amended by the department?
It depends on the Govt. but reservation for LDCE can not exceed 50% in any case. Since present percentage is 75:19:6 so this can be 80:20 also. 6% is out now. In case department moves to change the present percentage as above then they will have to change the Sr. Postmaster recruitment rules 2010 where 87 posts have to be distributed in 80:20 or any other agreeable percentage/ratio to give natural justice. In this case the ambition of department to post young and energetic Sr. Postmaster as given in recruitment rules will cease. 
Can general line officials selected through LCDE be posted as Sr. Postmaster,   particularly when department has carved out Postmaster cadre from general line and 29 posts of Sr. Postmaster are to be filled through seniority basis.
Department will definitely take options. In case no one opts for Sr. Postmaster then the department can posts juniors as Sr. Postmaster. Moreover seniority for both PS Group ‘B’ & Sr. Postmaster in class-I is combined. However if there is a case from Postmaster Grade III (HSG-I) officials to promote them as Sr. Postmaster on 29 posts earmarked for them on seniority cum fitness under their quota as per recruitment rules 2010, then department will be in a fix. The department has taken exam for 25 vacancies of 2010 and recruitment rules for the same have also been framed in 2010.   
How department has originally calculated 32 vacancies for PS Group ‘B’ when there were only 3 vacancies under 19% quota.
The department has calculated 19% of the 170 vacancies occurred during the year, whereas the vacancy based roster has long back been replaced with post based roster. So I request all the IP/ASPs to read the ruling on post based roster carefully before questioning my credibility.This will be beneficial to you in examination and you will find who is wrong and who is right. The IPASP without establishment and staff branch knowledge is not a perfect Inspector whatsoever examination they may pass.

BE READY TO SUPPORT 5TH JULY STRIKE

Copy of letter on the decision taken by CHQ to extend support to the proposed indefinite strike call given by Postal JCA is reproduced below for the information of IPASP  with the request to act accordingly.

Sub: EXTENSION OF SUPPORT TO THE PROPOSED INDEFINITE STRIKE CALL GIVEN BY POSTAL JOINT COUNCIL OF ACTION.
As all of us are well aware the Postal Joint Council of Action comprising NFPE, FNPO and GDS Unions has given a joint call for indefinite strike from July 5th 2011. The Department is going ahead with the Mail Network Optimisation Project recommended by the multinational consultancy called Mckinsey, which will have for-reaching implications. Thousands of Post Offices and RMS Sorting Offices are under the threat of closure. Unfortunately, the Department is not ready to take the employees or their Unions/Associations into confidence while implementing such measures. The other issues raised in the charter of demands are also equally important.

The Inspector, Posts cadre is one of the most neglected cadre in the Department. We are forced to work day and night for achieving targets fixed by the superiors, in addition to our day-to day inspection and other routine work without any extra remuneration. We are doing an excellent work as the middle level managers. Inspite of all this, our genuine demands for up-gradation of Grade Pay and better promotional avenues have not yet been considered positively by the Department. Our minimum demands for up-gradation of Grade Pay for Inspector, Posts and cadre restructuring to ensure better promotional avenues are still pending. We are in dark when these demands will be accepted by the Department for implementation. Our letters and memorandums are not being considered in a positive manner. There is great resentment among the IPs and ASPs working through out the country against the attitude of the Department.

We are seriously considering the appeal from the Postal JCA to join the strike. Pending decision by our Central Working Committee, we hereby extend our full and whole hearted support to the proposed indefinite strike from July 5th. We like to make it clear that we shall not act as strike breakers. However, it is also made clear that we shall work within the sphere of duties of Inspector, Posts cadre only in the event of the strike.

CALCULATION OF VACANCIES

Dear Nithya,
You have rightly questioned why I have removed all the comments from the Punjab blog spot. Sir, I do not know whether you will believe or not but it is true that IP cadre is the most egoistic cadre. It is my bad luck that I am one of them. It is also fact that in Punjab blog some anonymous derogatory comments against Circle Secretaries and their members were being published particularly from Kerala, Tamil Nadu and Maharashtra forcing me to block such comments. This was the only option left with me to chuck out such personal and cowardly acts. It is natural that ambitions flourish in every mind but on the other side of the coin there lies a fact that we should not try to skip the rope by tumbling down the significance of our senior and experienced counterparts. We should not keep eye on the enhanced and wrongly calculated vacancies for our selfish benefits. We should also not keep gradation list with us to locate our position and count the days ahead for getting promotion at the demise of our seniors----the lexis taken from the book “MY JOURNEY ON THE CHARIOT OF TIME”.

Moreover these days I am reading an Autobiography written by Sh. EM Samuel our former SSPOs (09826824981) that has given a true reflection of the mentality of the IP cadre. The memoir forwarded by Sh. G S Asiwal heightens, “The postal organization with democratic set up is run by bureaucrats whose mindset is autocratic and despotic like their British predecessors”.  In fact we are a part of it. Analogous to the imperialistic empire, the capitalistic administration now-a-days is growing from roots to top not because of its efficiency but because of our immature thoughts that have made us merely a dormant extenuator within own cadre.

So I request you to go through the following tabulation carefully and find your position within, you will personally realize the difference.The calculation of vacancies should be  as under. I do not know whether department will agree to it or not.

Out of 52 post earmarked for General line officials 27 are working IN Group B and 25 vacancies are there. Otherwise 23 posts remained for promotion from general line for PS Group B and 29 posts have been earmarked for Sr. Postmaster Cadre.
