REQUEST TO GS TO TAKE UP ISSUE WITH DIRECTORATE

Dear GS
It is to inform you that authority of Punjab postal Circle has not allowed some of our members to fill the OMR sheet on the ground that training period spent before induction in IP cadre is not to be reckoned as qualifying service. The second reason being adverse entry like ‘warning’, ‘reprimand’ emerged in last 5 years’ ACR/APAR, though otherwise their grading in APAR remains between 6-8(very good).
Since both the reasons of the department are unfounded and against the rules in vogue so this request. In view of such acts, few members of this Association have knocked the doors of Courts for relief and as such got relief. Hon’ble CAT Ernakulam Bench OA No. 380/2012 and 232/2012 filed at Bangalore CAT bench may kindly be referred to. Since our members were not part to any OA filed by other members and get relief so they approached Directorate through different representations to allow them to appear in the examination. Their representations are still pending for decision and as such, the circles will not be in a position to allow them to fill OMR sheets. Not allowing all eligible even those who have not approached the court will be against the natural justice and infringement to article 14 & 16 of the Constitution. It will also be a discrimination to other eligible similar situated candidates who are not party to the OA.
In view of above it is requested to take up case with directorate immediately with the request to either allow all similar situated IP/ASP by issuing roll number well before examination or the examination may be postponed to afford opportunity.
It is to inform you that I have already mailed my comments on organizational restructuring in DOP, the same may kindly be accepted.

INTERIM RELIEF FOR PS GR.B ASPIRANTS


The Hon'ble CAT Ernakulam Bench passed an interim order today (21/5/2012) in favour of the applicants in OA No. 380/12 filed by Sri. M.P.Ramesh and Smt. V.Sarada. The applicants had approached the Tribunal aggrieved by the stand taken by the Department that the IP induction training period cannot be taken into account for determining the length of service required for the PS Group B Examination. When the said OA came up for admission today (21.5.2012), the Hon'ble Tribunal passed an interim order directing the respondents to admit the applicants provisionally for the PS Group B examination scheduled to be held on 3.6.12 and also to issue OMR applications to the applicants.

Respected Madam,
          Kindly refer to this Association letter of even number dated 3/5/2012 (copy enclosed) on the above mentioned subject.
         This Association would like to bring to your kind notice that many of our members who have received any adverse within a span of five years and few members induction training period spent before entering in IP cadre was not counted as qualifying service are not allowed to fill the OMR sheet and even not given opportunity by providing kit thereby making them ineligible to appear for the said examination.
           As per the GOI Instructions contained in Rule 11(21) of CCS (CCA) Rules-1965, an official can be admitted to the examination if though the official is under suspension or disciplinary case is contemplated but here the official having good record and let off with warning  by virtue of his minor lapse has been debarred by Circles.  Moreover, the condition and procedure governing the selection for promotion to Group ‘B’ posts are given in the relevant para of a set procedure that cannot be ignored.
          Regarding condition and procedure governing LDCE, the provisions of relevant Recruitment Rules and administrative instructions issued from time to time needs to be referred to. It is not understood why the Department is going against the rules to promote officials of their choice without any healthy competition. Under such circumstances nobody will own responsibility because, madam you can see that in our Department ‘warning’ is a meagre issue and is imposed even without wrong doing.
          It is pertinent to mention here that Directorate vide letter no 23-1/2012-PE-II dated 10-5-2012 has called for comments of Circles to revisit the norms for creation of new postal divisions and up-gradation of existing Class-II Divisions into Class-I Divisions. This will again disturb established arrangement. It is not understood why department is inclined to conduct examination without completion of the prerequisites.
          Furthermore, the department is in the process of amending Recruitment Rules and there will be definite variation in number of vacancies under each quota. That is why the Department could not calculate and advertise number of vacancies for the given examination. The new casting will definitely disturb the present settled position. This Association therefore request that in order to make the entire process transparent, our Association should be consulted before the revision of Recruitment Rules and other related issues such as debarring the officials from examination so that our members are not taken as surprised.
          This Association further brings to your kind notice that, PS Group ‘B’ Recruitment Rules are not revised since years together and as per the clause 3.1.5 of Department of Personnel and Training OM No. AB-14017/48/2010-Estt (RR) dated 31st December, 2010 “The Recruitment Rules should be reviewed once in 5 years with a view to effecting such changes as are necessary to bring them in conformity with the changed position, including additions to or reduction in the strength of the lower and higher level posts”. This Association has already submitted the detailed proposal under letter dated 4/7/2011 regarding distribution of quota for PS Gr. B Examination and Sr. Postmaster Examination and also requested to notify the vacancies of both the examinations together. But till date vacancies are neither notified nor Recruitment Rules of PS Gr. B cadre are amended.
           In view of the above submissions, your kind honour is once again requested to look into the matter personally and arrange for withdrawal of the notification issued to conduct the PS Gr. “B” examination scheduled to be held on 3rd June 2012 and hold the said examination only after the issue of Revised Recruitment Rules of PS Gr. B Cadre along with vacancy position of both Examinations (PS Gr. B and Sr. PM) together. It is also requested to issue necessary instructions to all Circles to allow the IPs/ASPs who are declared ineligible on the above mentioned grounds & allow them to fill OMR sheets to avoid litigation in the matter.

ESSENCE OF BEWILDERMENT

Sub:    Regarding circulation of threat letter amongst all Unions by the parents of Sh.Kulbhushan Kakar, SPOs Kapurthala, probably on the behest of Sh. Kakkar.
Sir/Madam,
This is to bring to your kind notice that an impression of bewilderment has been tried to create by circulating a letter amongst staff union by the Parents of Shri Kulbhushan Kakkar, SPOs Kapurthala. In this letter, various frivolous and baseless allegations have been leveled against our members. Since Shri Kulbhushan Kakkar is seeking support from the service union and he has not denied circulation of this letter so, it can now explicitly be termed that the parents of Shri Kulbhushan Kakkar has circulated this letter on the behest of their son and has been approved by him. 
The instant threat letter is not only intended for accomplishment of vested interest purely on coercion and duress but to defame and demoralize the IP cadre / IPASP Association amongst revered unions of All India level and Circle level by leveling frivolous, unfounded, baseless allegations. It has been urged upon all unions to extend full hearted support in fighting for their justice. Shri Kulbhushan Kakar through this letter has targeted the members of the association by naming them in individual capacity and has also targeted the association by using derogatory words like over jealous, lobbying, buttering of senior officers etc. Association and its members particularly named in this letter vehemently refute the allegations leveled against them and condemned such type of instigation.
The distribution of instant letter upto the smallest units of our department like GDS has absolutely tarnished the image of IP Cadre amongst them. Where IP Cadre, acting as a part of Administration shoulders the responsibilities for implementation of Govt policies and discharged them at all cost, now after distribution of such disgraceful contents amongst them, constant humiliation is being suffered by the cadre without their any fault, reason or rhyme and it has become difficult to discharge duties in this adverse environment
Sir, you will agree that if a Divisional Head adopts/resort to demonstration like indefinite hunger strike for his vested interest, what can be expected from subordinate staff being supervised by Divisional Head/ASP/IP such as PA/SA, Postman/MTS, GDS etc.
 Needless to say, Legal recourse is a constitutional right provided to every citizen of India, and he/she can approach the Hon’ble Courts/Bench whenever he/she is deprived of any legitimate right or discriminated. As such, filing of Civil, Criminal or application before Hon’ble Forum/Courts cannot be held as sacrificial to someone or indiscrimination. Association has filed the Court case in respect of Group B Examination only for their legitimate right, not in the context that Mr Kakkar is appearing in this examination, but due to incorrect calculation of PS Group B Vacancies, and Hon’ble Court was kind enough to award justice in our favour.     
Association feels that such type of threats that too in the present times cannot be taken lightly. It is, therefore, earnestly requested to initiate suitable action against the said officer. A stern action in this regard is welcomed so that the same would act as a deterrent in future. It is hoped that Administration would rise to the occasion. However, association is opened to any such investigation & inquiries by the appropriate level/authority, in case, needed be.

DPC FOR IPs

Much awaited DPC for promotion of IPs to ASPs has been convened for eleven vacancies. Posting orders will be issued shortly. Association is thankful to Chief PMG , Director(HQ) and APMG (Staff) for taking immediate action on our request letter.

COMMENT ON COMMENTS


Our brain can remember everything and interpret them well, more than a computer so my humble request to all my colleagues is to use their brain and should not rely on others. Second request of mine, as usual, is a request to mention your name while commenting on blog otherwise don’t ask where my comments are. Now reply to 1st comment is --- I am not astrologer, it is up to the department to take decision but that should be under the ambit of set rules. Our GS has already requested department to conduct LDCE as and when vacancy arises under respective quota after amendment of recruitment rules. Department has taken decision to conduct PS Group ‘B’ exam on 3rd June, may be under old recruitment rules only. Nevertheless, Punjab Circle Association will not move any application against the said examination if the vacancies are notified as per these rules. Vacancies under each category as per existing recruitment rules should be around 19 in 165 point roster (IP line) and 2 in 52 point roster (General line). Any wide variation can force us to reverse our stand.

As regards, 2nd comment-- the detail will be put on blog after next date of hearing after consulting our Advocate.This time main emphasis of the department is  article 309 of the constitution of India 1949 that envisages  “recruitment and conditions of service of persons serving the Union or a State Subject to the provisions of this Constitution, Acts of the appropriate Legislature may regulate the recruitment, and conditions of service of persons appointed, to public services and posts in connection with the affairs of the Union or of any State: Provided that it shall be competent for the President or such person as he may direct in the case of services and posts in connection with the affairs of the Union, and for the Governor of a State or such person as he may direct in the case of services and posts in connection with the affairs of the State, to make rules regulating the recruitment, and the conditions of service of persons appointed, to such services and posts until provision in that behalf is made by or under an Act of the appropriate Legislature under this article, and any rules so made shall have effect subject to the provisions of any such Act”.

Sr. POSTMASTER CAT CASE UPDATE

Sr. Postmaster CAT case came up for hearing today before the Hon'ble CAT bench Chandigarh. Department has filed written reply.The case has been adjourned to 24.5.2012.

LETTER TO DG(Posts) FROM CS

Sub:     Convening of regular DPC for promotion to PS Group ‘B’
Respected Madam,
I intend to bring to your kind attention one of the areas, where delay is occurring in non-convening of DPC for promotion of IP/ASP to PS Group ‘B’.
2.         In this connection, attention is invited to the consolidated instructions on DPC, circulated vide DOP&T’s OM No.22011/5/86-Estt.D dated 10.4.89, which, interalia, provides that DPCs should be convened at regular intervals to draw up panels which could be utilized for effecting promotions/against vacancies occurring during the course of a given year. These instructions enjoin upon the concerned authorities to initiate action to fill up the existing as well as anticipated vacancies well before the expiry of the previous panel in their respective reservation quota that is not covered in adhoc promotion. Moreover adhoc promotions can not provide uniformity amongst Circles as the vacancy positions differ from Circle to Circle.
3          According to the standing instructions, action for convening the DPCs should be initiated before the commencement of the vacancy year and that DPCs should be held against future vacancies so that justice is met to all and no category feel isolated. Non convening of timely DPC is effecting next financial up-gradation (MACP) to the officers. 
4.       It is understood that 22 TO 23 vacancies out of 649 posts of PS Gr. B earmarked for 75% quota are lying vacant for the vacancy year 2011, so supplementary DPC for the vacancy year 2011 may please be ordered to conduct before any promotion through LDCE. Any overlapping under different quota can lead to legal complication and cause creation of supernumerary post for the promotion of all seniors being set rules and procedure.      
5.         In view of the above, it is requested that suitable orders may kindly be passed to put in place immediately for calling records and required planning is done to convene the DPC, not only for the left out vacancies for the year 2011, but also for the vacancy years 2012, so that panels are prepared in time allowing sufficient time is given to the officers to join well before time and that the extant orders on the subject are followed, both in letter and spirit.

LETTER FROM GS TO SECRETARY(POST)

Subject   :  Limited Departmental Competitive Examination for promotion to the cadre of PS Gr. B 2012.

Respected Madam,
The department has issued orders vide No.  A- 34012/6/2011-DE dated 10-4-2012 scheduling PS Group ‘B’  examination to be held on 3rd June 2012 without notifying the number of vacancies and other pre-requisites for conducting exam to keep these orders under the ambit of set rules. The department is also not acting as per recruitment rules framed and notified. Madam, you will agree that PS Group ‘B’ Recruitment Rules 1987 amended from time to time are still in force and without amendment of these rules, the Postmaster recruitment rules 2010 can not come into force . It is understood that 116 posts earmarked for Sr. Postmaster are to be carved out from the total 866 posts of PS Group ‘B’ with no intention to create new post to bring Postmaster recruitment rules 2010 inforce without amending  PS Group ‘B’ recruitment  rules .
Association vide  letter no CHQ /PS Gr. ’B’/2011 dated 04.07.2011 gave a detailed proposal regarding distribution of quota under each category to the Department for consideration and implementation in the interest of both IP Line and General Line officials but nothing has been done by the Department in this regard so far. Now again the department has notified the examination without amending recruitment rules that is not in the spirit of justice. In this, regard Dte. order no 11-15/2007-SPG dated 7-01-2009  issued consequent upon decision of OA No. 657/HP/2007 refers. The recently announced OA No. 399/PB/2011 has orders to promote IPs under respective quota only.
In view of above facts, both the examination viz PS Group “B” and Sr. Postmaster should only be conducted as and when a vacancy arises under the respective quota after amendment of recruitment rules. The ASPs/ HSG-I IP line Postmaster should also be allowed to appear in both examination for greater justice of the cadre that is born on the same gradation list and IP that is the feeder cadre for further promotion for all purposes and not ASP/HSG-I which is simply a non functional post. It is therefore requested to kindly withdraw the notification issued to conduct the PS Group ‘’B” examination.
